أ-لا يجوز نزع ملكية أي استثمار أو جزء منه إلا بمقتضى القانون ولغرض عام ومحدد ومشروع
وبطريقة غير تمييزية مقابل دفع تعويض عادل للمستثمر.
ب- يراعى عند دفع التعويض المشار إليه في الفقرة (أ) من هذه المادة ما يلي:-
1 - أن يدفع دفعة واحدة بالدينار الأردني أو بعملة قابلة للتحويل.
2 . - أن يكون مساوياً للقيمة السوقية العادلة للأصول المعنية قبل اتخاذ قرار نزع الملكية
3 - أن يشمل سعر فائدة يعادل التمويل المضمون لليلة واحدة الذي ينشره يومياً البنك المركزي
