ان الضرورة في التزام النفقات المفيدة للسفينة او للحمولة يجب ان يتحققها في الاردن قاضي
صلح العقبة وفي الخارج القائم
بالسلطة القنصلية اذا وجد والا فالقاضي المحلي.
يشرف القاضي ذو الصلاحية على اجراء القرض بالمناقصة العلنية فترسو احالته على المقرض
الذي يعرض ادنى مقدار للفائدة
البحرية.
ولكن يمكن الترخيص في عقد القرض بالتراضي عند اقتضاء الحال.
