لا يمكن استحضار المؤمنين الا امام محكمة مكان توقيع العقد ولكن اذا وقع على العقد وكيل ،
فللمؤمن له ان يدعي امام
محكمة مقام المؤمن.
واذا وقع في مكان واحد على اكثر من نصف قيمة التأمين فللمؤمن له ان يستحضر سائر
المؤمنين امام محكمة هذا المكان التي
تكون قد وضعت يدها على الدعوى بغية فصلها بمواجهتهم.
