ليس للغير حق الرجوع الا على الشريك الذي تعامل معه في شركة المحاصة ، فاذا أقر أحد
الشركاء فيها بوجود الشركة او
صدر عنه ما يدل للغير على وجودها بين الشركاء جاز اعتبارها شركة قائمة فعلاً ، واصبح الشركاء
فيها مسؤولين تجاه ذلك
الغير بالتضامن.
