- أ- على اللجنة وخلال يومي عمل النظر بصفة الاستعجال في طلب التظلم في أي من الحالات
التالية: -
1 -إذا كانت طبيعة الإجراء أو القرار المتخذ بحق المستثمر يؤثر بشكل كبير على سير عمل النشاط
. الاقتصادي أو إنتاجيته أو يؤدي الى وقف أعماله
2 -إذا نصت تشريعات الجهة الرسمية على مدد محددة يخشى فواتها لتقديم المستثمر طعنه
. أمام المحكمة المختصة
ب- على الجهة الرسمية الرد على طلب التظلم المقدم وفقا لأحكام الفقرة (أ) من هذه المادة
( خلال مدة لا تزيد على 3 ) أيام عمل من تاريخ استلامها هذا الطلب.
