Real Property Ownership Law No. 13 of 2019
Article text
ينظم سند الرهن ويسجل لدى مديرية التسجيل، ويتولى
مديرها، أو من يفوضه من موظفيها، القيام بما يلي:-
أ- التصديق على سند الرهن بعد أن يقر بحضوره كل من
الراهن والدائن المرتهن في السند بموافقتهم على ما ورد
فيه، وبعد أن تدون فيه بصورة مفصلة محال إقامتهم.
ب- ادراج إشارة في السجل العقاري للعقار تفيد بأنه
مرهون رهناً تأمينياً مع بيان مرتبة الرهن وإعطاء كل من
الراهن والدائن المرتهن نسخة من سند الرهن و القيد
مقابل توقيعهم بتسلمها.
