Article text
للدائن المرتهن رهناً تأمينياً عقارياً، أياً كانت مرتبة رهنه، أن
يطلب إلى دائرة التنفيذ المختصة تنفيذ سند الرهن وبيع
العقار المرهون تأميناً لدينه بالمزاد العلني في حال تخلف
المدين عن تأدية الدين عند حلول أجل الوفاء به أو في حال
تحقق شرط في سند الرهن يقضي بسقوط الأجل لتخلف
المدين عن الوفاء بما تعهد به.
