Article text
أ- إذا ثبت للمدير وجود خطأ في حساب المساحة المستملكة في خريطة الاستملاك أو التنظيم،
يصدر أمر تصحيح هذا الخطأ في حساب المساحة المستملكة ويبلغه للمستملك الذي عليه أن
يقوم بنشره على موقع الدائرة الإلكتروني وفي صحيفتين يوميتين محليتين من الصحف الثلاث
الأوسع انتشارًا في حال تأثر حق المالك في التعويض عن الاستملاك بنتيجته زيادة أم نقصاناً .
ب- يلزم المستملك بأن يدفع للمالك ما نقص من التعويض الذي يستحقه عن المساحة
المستملكة بمقتضى أمر تصحيح خطأ حساب المساحة المستملكة، وفقا للقيمة المقررة
للتعويض عن الاستملاك، كما يلزم المالك برد ما قبضه زيادة على ما يستحقه من تعويض
بمقتضى هذا الأمر، فإن امتنع عن رده تحصل الزيادة منه وفقا لقانون تحصيل الأموال العامة.
