Article text
أ- إذا كان حق التصرف على الشيوع في عقار بين أهالي قرية واقعة ضمن نطاق منطقة تسوية،
فيجوز قبل المباشرة بتنظيم جدول التسجيل تقسيم العقار بين أهالي القرية المدرجة أسماؤهم
في جدول الحقوق النهائي على النحو التالي:-
1 ( - باتفاق خطي موقع من 3/4 ) ثلاثة أرباع فأكثر من أصحاب الحصص المدرجة في جدول الحقوق
( النهائي من أهالي القرية، مصدق من المدير، وذلك خلال 60 ) ستين يوماً من تاريخ تصديق جدول
الحقوق.
2 ( - بقرار من المدير وبالصورة التي يراها مناسبة، في حال تعذر اتفاق 3/4 ) ثلاثة أرباع أصحاب
الحصص المدرجة في جدول الحقوق النهائي من أهالي القرية على القسمة بينهم، أو في حال
تعذر إتمامهم القسمة خلال المدة المحددة لهم لهذا الغرض.
ب- تمسح القطع الناتجة من قسمة العقار المشاع وتدرج في جدول التسجيل وتسجل في
السجل العقاري للقرية وفقاً لنتائج تلك القسمة.
