الفصل السادس عشر
الاحكام والقرارات
أ- في غير القضايا التي تنظر تدقيقاً:-
1 - تعلن المحكمة ختام المحاكمة بعد الانتهاء من إجراءاتها وعليها ان تنطق بالحكم علانية في
الجلسة نفسها وإلا ففي جلسة تالية تنعقد لهذا الغرض خلال عشرة أيام على الأكثر ، واذا تغيب
الطرفان أو أحدهما فلا يمنع المحكمة من إصدار حكمها .
2 - للمحكمة ان تعيد فتح المحاكمة قبل النطق بالحكم لأي أمر ترى انه ضروري للفصل في
. الدعوى
3 - ينطق بالحكم علناً رئيس الجلسة أو القاضي حسب مقتضى الحال ويجب ان يحضر القضاة
الذين اشتركوا في المداولة النطق بالحكم واذا كان موقعا من هيئة المداولة وتغيب بعضهم أو
كلهم يجوز تلاوته من هيئة أخرى على ان يؤرخ الحكم بتاريخ النطق به ويثبت ذلك في ذيل
الحكم .
4 - تحفظ مسودة الحكم المشتملة على أسبابه ومنطوقه موقعة من الرئيس والقضاة و لا
. تعطى صورة عنها للخصوم ولكن يجوز الاطلاع عليها إلى حين تمام النسخة الأصلية
ب- تكون المداولة في الأحكام سرية بين القضاة مجتمعين ولا يجوز ان يشترك فيها غير القضاة
الذين نظروا الدعوى .
ج- يسمع الرئيس آراء القضاة الأعضاء ويبدأ بأحدثهم .
د- تصدر الأحكام بالإجماع أو بالأكثرية وعلى القاضي المخالف ان يبين أسباب مخالفته في ذيل
الحكم .
