Article text
على الرغم مما ورد في هذا القانون وفي أي تشريع آخر:-
أ - يجوز تقديم الدعاوى والطلبات والطعون وتسجيلها وقيدها ودفع الرسوم وتقديم اللوائح وتقارير الخبرة
والتحكيم والبينات الخطية وسائر الأوراق القضائية وإجراء التبليغات والمخاطبات والإنابات والمحاكمات بما
في ذلك تحليف الأيمان وسماع الشهود والخبراء دون المساس بحق المناقشة بالوسائل الإلكترونية
والتقنيات الحديثة.
ب - يجوز للمحكمة استخدام الوسائل الإلكترونية والتقنيات الحديثة في سماع الإقرارات وأقوال ذوي العلاقة
وإجراء وتوثيق العقود والاتفاقيات والتصرفات.
ج- يجوز للنيابة العامة الشرعية استخدام الوسائل الإلكترونية والتقنيات الحديثة في جميع أعمالها بما في
ذلك تلقي الطلبات والبلاغات وإجراء التحقيقات.
د- يجوز لمكاتب الإصلاح والوساطة والتوفيق الأسري استخدام الوسائل الإلكترونية والتقنيات الحديثة في
جميع أعمالها بما في ذلك إجراء التبليغات وعقد جلسات الإصلاح والإرشاد وتنظيم الاتفاقيات.
هـ - تطبق الاحكام الواردة في الفقرتين (أ) و (ب) من هذه المادة على الدعاوى والإجراءات لدى محاكم
التنفيذ.
و- يكون للنسخ المستخرجة من البيانات والمعلومات والوثائق مما تم حفظه إلكترونيا لدى دائرة قاضي
القضاة او المحاكم بعد ختمها بالخاتم الرسمي وتوقيعها من الجهة المختصة حجية السند الأصلي.
ز- تحدد احكام وشروط وإجراءات استعمال الوسائل الالكترونية والتقنيات الحديثة وتخزين البيانات
والمعلومات والوثائق بمقتضى نظام يصدر لهذه الغاية .
