الفصل العشرون
رد القضاة
يكون القاضي ممنوعاً من نظر الدعوى وعليه ان يتنحى عن نظرها وان لم يطلب احد الخصوم
رده، وذلك في الأحوال التالية :-
أ- إذا كان زوجاً لأحد الخصوم أو كان قريباً أو صهراً له إلى الدرجة الرابعة .
ب- إذا كان له أو لزوجه خصومة قائمة مع احد الخصوم أو مع زوجه .
ج- اذا كان وكيلاً لأحد الخصوم في أعماله الخاصة أو وصياً عليه أو قيماً أو مظنونة وراثته له أو
كان زوجاً لوصي احد الخصوم أو القيم عليه أو كانت له صلة قرابة أو مصاهرة للدرجة الرابعة بهذا
الوصي أو القيم .
د- إذا كان له أو لزوجه أو لأحد أقاربه أو أصهاره على عمود النسب أو لمن يكون وكيلاً عنه أو وصياً
أو قيماً عليه مصلحة في الدعوى القائمة .
هـ- إذا كان بينه وبين احد قضاة الهيئة صلة قرابة أو مصاهرة للدرجة الرابعة أو كان بينه وبين
المدافع عن احد الخصوم صلة قرابة أو مصاهرة للدرجة الثانية .
و- إذا كان قد أفتى أو ترافع عن احد الخصوم في الدعوى وان كان ذلك قبل اشتغاله في القضاء
، أو كان قد سبق له نظرها قاضياً أو خبيراً أو محكماً أو كان قد أدى شهادة فيها .
ز- إذا رفع دعوى تعويض على احد الخصوم أو قدم بصفته الشخصية بلاغاً أو شكوى لأي جهة
ضده.
