Article text
أ- يجوز للمستأنف عليه أن يقدم استئنافا إما بالإجراءات المعتادة أو بمذكرة مشتملة على أسباب
استئنافه، ويعتبر الاستئناف أصليا اذا رفع في ميعاد الاستئناف، واستئنافا تبعيا إذا رفع بعد الميعاد
أو إذا كان رافعه قد قبل الحكم في وقت سابق ، ومدة الاستئناف التبعي عشرة أيام من اليوم
التالي لتاريخ تبلغ لائحة الاستئناف الأصلي .
ب- يتبع الاستئناف التبعي الاستئناف الأصلي ويسقط إذا تنازل المستأنف عن استئنافه أو حكم
بعدم قبول الاستئناف الأصلي شكلاً أما الاستئناف الأصلي فلا يزول بزوال الاستئناف التبعي أياً
كانت الطريقة التي رفع بها .
ج- يجوز لفريقين أو أكثر في الدعوى أن يشتركوا في استئناف واحد.
د- يجب أن تتضمن لائحة الاستئناف الأمور التالية :-
1 - اسم المستأنف ووكيله وعنوانه .
2 . - اسم المستأنف عليه ووكيله وعنوانه
3 - اسم المحكمة التي أصدرت الحكم أو القرار المستأنف ورقمه وتاريخه ورقم الدعوى التي صدر
. فيها
4 - ذكر جميع أسباب الاستئناف في اللائحة بصورة واضحة وخالية من التكرار وفي بنود مستقلة
. ومرقمة بأرقام متسلسلة
5 - الطلبات وتوقيع اللائحة.
