Article text
اذا فسخ الحكم واعيدت القضية الى المحكمة البدائية لسماعها مجدداً أو اتمام اجراءاتها.
أ- تستدعي المحكمة البدائية الطرفين خلال عشرة ايام من تاريخ اعادة القضية اليها وعند السير
في المحاكمة يتبع القاضي
ما جاء بقرار الفسخ ويتم اجراءات القضية.
ب- في حالة اصرار القاضي البدائي على قراره واستئناف الحكم ثانية تدقق محكمة الاستئناف
فيه وتصدر قرارها اما بتأييد
الحكم او فسخه وفي الحالة الاخيرة لمحكمة الاستئناف هذه رؤية القضية مرافعة أو اعادتها
للمحكمة ليراها قاض اخر
انتداباً.
