Article text
أ- تختص النيابة العامة الشرعية دون غيرها برفع الدعاوى المبينة أدناه ما لم ترفع من ذوي
الشأن:-
1 - دعاوى الحق العام كدعاوى إثبات الطلاق وفسخ عقد الزواج للفساد أو البطلان .
2 - محاسبة الأولياء والأوصياء والقوام والمتولين والنظار وما يترتب عليها من آثار كسلب الولاية
. أو الحد منها
3 - عزل الأوصياء والقوام والمتولين والنظار .
4 . - إبطال الإذن بالتصرف في أموال فاقدي الأهلية وناقصيها اذا شابه غش أو غبن فاحش
5 . - الإلزام بحضانة القاصرين أو ضمهم عند التعيّن أو عند وجود خطر يخشى منه على المحضون
ب- اذا لم ترفع أي من الدعاوى المنصوص عليها في الفقرة (أ) من هذه المادة من ذوي الشأن
وقدم طلب أو بلاغ للمدعي العام الشرعي بوقائع تتعلق بأي منها فعليه بعد إجراء التحقيقات
اللازمة ان يقرر رفع الدعوى إلى المحكمة المختصة أو حفظ الأوراق حسب مقتضى الحال خلال
ثلاثين يوماً من تاريخ تلقي الطلب أو البلاغ .
- ج 1 - يبلغ المدعي العام الشرعي قراره بحفظ الأوراق إلى المدعي العام الشرعي الأول
المختص الذي له تصديق القرار أو فسخه.
2 - في حال فسخ المدعي العام الشرعي الأول القرار تعاد الأوراق للمدعي العام الشرعي لإتباع
. قرار الفسخ
د- تكون النيابة العامة الشرعية في أحوال رفعها للدعوى طرفاً أصلياً فيها ولها ما للخصم
العادي من حقوق .
