يكون تدخل النيابة العامة الشرعية اختيارياً في :
أ- الدعاوى التالية :-
1 - الحجر وفكه .
2 . - رد القضاة
3 . - النسب وإثبات الزواج، والتفريق بين الزوجين
4 . - الدية في النفس وما دونها
5 . - الحضانة والضم
. ب- التركات الواجبة التحرير
ج- الحالات التي ترى المحكمة تدخل النيابة العامة الشرعية فيها لتعلقها بالآداب أو النظام
العام .
