الفصل الحادي عشر
البينات الكتابية
- أ 1 - المستندات الرسمية هي التي ينظمها موظفون رسميون يكون من اختصاصهم تنظيمها
كوثيقة الزواج وشهادة الميلاد وسندات التسجيل والوثائق التي ينظمها الكاتب العدل أو من
في حكمه وتعتبر هذه المستندات بينة قاطعة على ما نظمت لأجله و لا يقبل الطعن فيها إلا
بالتزوير .
2 ( - يعتبر مأذون توثيق الزواج موظفاً لمقاصد أحكام البند 1 ) من هذه الفقرة .
ب- يجوز إثبات صحة تنظيم أي مستند أو عقد أو وكالة أو صك كتابي منظم أو موقع خارج
المملكة بإحدى الطرق التالية :-
1 - إقرار الفريقين المتعاقدين أمام المحكمة .
2 - تصديقه من السلطات المختصة في الدولة التي نظم أو وقع فيها ومن سفارة المملكة أو
. قنصليتها في تلك الدولة إن وجدت
3 - إقرار الفريقين المتعاقدين أمام الكاتب العدل أو من يقوم مقامه في احدى سفارات
. المملكة أو قنصلياتها
