Article text
يجتمع الخبراء في الزمان والمكان المعينين من القاضي ويباشرون العمل تحت اشرافه او
اشراف نائبه وبحضور الطرفين على الوجه الآتي:
1 - اذا اتفق الطرفان على الاوراق التي ستتخذ أساساً ومقياساً للتطبيق عمل باتفاقهما والا فتعتبر
. الاوراق التالية صالحة للتطبيق والمضاهاة
أ- التي وقع عليها المنكر بامضائه او خاتمه امام احدى المحاكم او الكاتب العدل او دائرة
التسجيل.
ب- التي وقع عليها خارج الدوائر الحكومية المختصة واعترف بهذا التوقيع امام احدى المحاكم او
الكاتب العدل او الدائرة الحكومية المختصة.
جـ- الاوراق الرسمية التي كتبها ووقعها وهو في الوظيفة.
د- المستندات العرفية التي يعترف المنكر بحضور القاضي والخبراء ان التوقيع او الخاتم
الموضوع عليها هو توقيعه او خاتمه.
2 - الخاتم أو التوقيع الموقع بها سند عرفي ينكره المدعي لا يجوز اعتباره اساسا صالحا للتطبيق
. وان حكمت احدى المحاكم في دعوى سابقة بناء على تقرير الخبراء انه خاتمه او توقيعه
