طلاق التعسف موجب للتعويض على المطلقة
( المادة 134 )
اذا طلق الزوج زوجته تعسفا كأن طلقها لغير سبب معقول وطلبت من القاضي التعويض حكم
لها على مطلقها بالتعويض الذي يراه
مناسباً بشرط ان لا يتجاوز مقدار نفقتها عن سنة ويدفع هذا التعويض جملة او قسطاً حسب
مقتضى الحال ويراعى في ذلك حالة
الزوج يسرا وعسرا و لا يؤثر ذلك على باقي الحقوق الزوجية الاخرى للمطلقة بما فيها نفقة العدة.
