في غياب الزوج تحلف اليمين وتقام البينة
( المادة 76 )
اذا تغيب الزوج وترك زوجته بلا نفقة او سافر الى محل قريب او بعيد او فقد يقدر القاضي نفقتها
من يوم الطلب بناء على
البينة التى تقيمها الزوجة على قيام الزوجية بينهما بعد ان يحلفها اليمين على ان زوجها لم
يترك لها نفقة وعلى انها
ليست ناشزة و لا مطلقة انقضت عدتها.
