1 - لا يجوز ملاحقة الزاني او الزانية الا بشكوى الزوج او الزوجة ما دامت الزوجية قائمة بينهما ، وكذلك بشكوى ولي الزانية ، وفي حا
ضد أحدهما او كليهما يلاحق الاثنان معا بالاضافة الى الشريك والمحرض والمتدخل في فعل الزنا ان وجدوا ، وتسقط الدعوى والع
المحكوم بها باسقاط الشاكي شكواه.
2 - لا تقبل الشكوى بعد مرور مدة ثلاثة أشهر من تاريخ علم المشتكي بالجريمة ، على ان لا تتجاوز هذه المدة في جميع الأحوال سن
تاريخ وقوع الجريمة .
