الاصرار السابق هو القصد المصمم عليه قبل الفعل لارتكاب جنحة او جناية يكون غرض المصر
منها إيذاء شخص
معين او أي شخص غير معين وجده او صادفه ولو كان ذلك القصد معلقاً على حدوث أمر او
موقوفاً على شرط.
