Article 330 bis of Penal Code No. 16 of 1960
Article text
1 - يعاقب بالحبس مدة ثلاثة أشهر أو بغرامة مقدارها الف دينار أو بكلتا هاتين العقوبتين كل من
أطلق عيارا ناريا دون داع أو سهما ناريا أو استعمل مادة مفرقعة دون موافقة مسبقة، ويصادر ما
تم استخدامه من سلاح، ولو كان مرخصا، وأي سهم ناري ومادة مفرقعة.
2 - وتكون العقوبة:
. أ- الحبس مدة لا تقل عن سنة إذا نجم عن الفعل إيذاء إنسان
ب- الأشغال المؤقتة إذا نجم عن الفعل أي عاهة دائمة أو إجهاض امرأة حامل.
ج- الاشغال المؤقتة مدة لا تقل عن عشر سنوات اذا نجم عن الفعل وفاة إنسان.
3 ( - تضاعف العقوبة الواردة في الفقرتين 1 ) ( و 2 ) من هذه المادة في حال التكرار أو تعدد المجني
