اذا كان المعتدى عليه قد جلب الحقارة لنفسه بعمله فعلا غير محق او قابل ما وقع عليه من حقارة
بمثلها او استرضي فرضي
، ساغ للمحكمة أن تحط من عقوبة الطرفين او من عقوبة أحدهما لأفعال الذم والقدح والتحقير
ثلثها حتى ثلثيها او تسقط
العقوبة بتمامها.
