( 2 ) الغش في نوع البضاعة
كل من غش العاقد عن معرفة سواء في طبيعة البضاعة او صفاتها الجوهرية او تركيبها او
الكمية التي تحتويها من العناصر
المفيدة او في نوعها او مصدرها عندما يكون تعيين النوع والمصدر معتبراً بموجب الاتفاق او
العادات السبب الرئيسي للبيع
يعاقب بالحبس من شهر الى سنة وبالغرامة من خمسة دنانير الى خمسين ديناراً او باحدى هاتين
العقوبتين.
