Article text
1 - يعد ممارسة للحق:كل فعل قضت به ضرورة حالية لدفع تعرض غير محق ولا مثار عن النفس أو
. المال أو نفس الغير أو ماله
2 - يستوي في الحماية الشخص الطبيعي والشخص المعنوي.
3 - إذا وقع تجاوز من المدافع بحسن نية بأن استعمل لدفع الاعتداء قوة تزيد على القدر اللازم دون أن يكون
قاصدا إحداث أذى أشد مما يستلزمه الدفاع جاز للقاضي إعفاء الجاني من العقوبة أو تخفيفها وفق شروط
( العذر المخفف المنصوص عليه في المادة 98 ) من هذا القانون.
