لا يعتبر شروعا في جريمة مجرد العزم على ارتكابها ولا الأعمال التحضيرية ، وكل من شرع في
فعل ورجع باختياره عن أفعال
الجرم الاجرائية لا يعاقب إلا على الفعل أو الأفعال التي اقترفها اذا كانت تشكل في حد ذاتها
جريمة.
