Article text
أ - تتمثل المصلحة التأمينية للمؤمن له أو للمستفيد في عقود التأمين على الأموال والتأمين
من المسؤولية المدنية بعدم تعرض محل التأمين للخطر المؤمن منه، ويشترط توافرها عند
انعقاد العقد وعند تحقق الخطر المؤمن منه ، وبزوالها ينفسخ العقد عقد التأمين حكما.
ب-يجوز أن تشمل المصلحة التأمينية مصلحة المؤمن له في الكسب الفائت الناجم عن تحقق
الخطر المؤمن منه شريطة النص على ذلك في عقد التأمين.
ج - تنتقل المصلحة التأمينية إلى الخلف العام ما لم يتم الاتفاق على خلاف ذلك.
