Article text
أ- إذا تخلف المسجل عن تقديم الاقرار الضريبي خلال المدة المحددة في هذا القانون ، تقوم
الدائرة بإصدار قرار تقدير أوَلي تحدد فيه قيمة الضريبة
المقدرة على المسجل عن الفترة أو الفترات الضريبية المعنية وأي غرامات ومبالغ أخرى متحققة
عليه ويبلغ المسجل اشعارا خطيا بنتيجة ذلك
القرار.
ب - تكون المبالغ المطالب بها بموجب الاشعار المنصوص عليه في الفقرة (أ) من هذه المادة
واجبة التحصيل بعد مرور ثلاثين يوما من تاريخ تبليغه
للمسجل ويعتبر أي مبلغ محصل منها دفعة على حساب الضريبة النهائية المستحقة عليه ولا
يعتبر هذا القرار نهائياً لغايات الاعتراض أو الطعن
القضائي .
ج- يعتبر قرار التقدير الأوَلي ملغى حكماً اذا قدَم المسجل الاقرار الضريبي عن الفترة أو الفترات
الضريبية المعنية ودفع الضريبة وأي غرامات
أو مبالغ أخرى مترتبة عليه بموجب ذلك الإقرار على أن يتم ذلك قبل صدور قرار التقدير الإداري وفق
( أحكام المادة 46 ) من هذا القانون .
د - لغايات هذه المادة يصدر المدير تعليمات لتحديد أسس وإجراءات التقدير الأوَلي .
