للمؤلف الذي وقع الاعتداء على أي حق من الحقوق المقررة له على مصنفه بمقتضى أحكام هذا
القانون الحق في الحصول على
تعويض عادل عن ذلك على أن يراعى في تقديره مكانة المؤلف الثقافية وقيمة المصنف
الأدبية أو العلمية أو الفنية له وقيمة
المصنف الاصلي في السوق ومدى استفادة المعتدي من استغلال المصنف ويعتبر التعويض
المحكوم به للمؤلف في هذه الحالة دينا
ممتازا على صافي ثمن بيع الأشياء التي استخدمت في الاعتداء على حقه و على المبالغ
المحجوزة في الدعوى.
