التفريق للغياب والهجر
إذا أثبتت الزوجة غياب زوجها عنها سنة فأكثر وكان معلوم محل الإقامة جاز
لزوجته أن تطلب من القاضي فسخ عقد زواجهما إذا تضررت من غيابه عنها
ولو كان له مال تستطيع الإنفاق منه.
