اذا ظاهر الزوج من زوجته ولم يكفر عن يمين الظهار وطلبت الزوجة التفريق
لعدم تكفيره عن يمينه أنذره القاضي بالتكفير عنه خلال أربعة أشهر من
تاريخ تبلغه الإنذار فإن امتنع لغير عذر حكم القاضي بالتطليق عليه طلقة
رجعية ما لم تكن مكملة للثلاث أو قبل الدخول .
