يسقط حق الحضانة في الحالتين التاليتين:
أ- إذا اختل أحد الشروط المطلوب توافرها في مستحق الحضانة.
ب- إذا سكن الحاضن الجديد مع من سقطت حضانته بسبـب سلوكه أو ردته أو إصابته بمرض
معد خطير .
