Article text
أ- إذا امتنع الحاضن عن تمكين المحكوم له من المبيـت أو الرؤية أو
الاستزارة أو الاصطحاب أو الاتصال بالمحضون دون عذر وتكرر تخلفه أو
امتناعه بعد إنذار رئيس التنفيذ له جاز لقاضي الموضوع بناءً على الطلب
إسقاط الحضانة مؤقتاً ونقلها إلى من يليه من أصحاب حق الحضانة ولمدة
محدودة لا تزيد على سنة وبما يراعي مصلحة المحضون .
ب- على من انتقل إليه حق الحضانة مؤقتاً تنفيذ حكم المبيت و الرؤيــة أو
الاستزارة أو الاصطحاب او الاتصال كأنه صادر بحقه .
ج- إذا تكرر تخلف المحكوم له عن الموعد المضروب لتنفيذ الحكم
بالمبيت أو بالرؤية أو الاستزارة أو الاصطحاب أو الاتصال دون عذر جاز لرئيس
التنفيذ بناء على الطلب وقف تنفيذ الحكم لمدة لا تزيد على ثلاثة أشهر .
