أ- تصرفات الصغير المميز صحيحة متى كانت نافعة نفعاً محضاً وباطلة
متى كانت ضارة ضرراً محضاً .
ب- أما التصرفات الدائرة بين النفع والضرر فتعقد موقوفة على إجازة الولي
في الحدود التي يجوز فيها له التصرف ابتداءً أو إجازة القاصر بعد بلوغه سن
الرشد.
ج- وسن التمييز سبع سنوات كاملة .
