الفصل الرابع: الوارثون بالفرض والتعصيب
- الوارثون بالفرض والتعصيب هم :-
أ- الأب أو الجد لأب مع البنت المنفردة أو بنت الابن وإن نزل أبوها .
ب- الزوج إذا كان ابن عم للمتوفاة يأخذ نصيبه فرضاً وما يستحقه ببنوة العمومة تعصيباً.
ج- الأخ لأم واحداً أو أكثر إذا كان ابن عم للمتوفى يأخذ نصيبه فرضاً وما يستحقه ببنوة العمومة
تعصيباً.
