اذا حدث قبل توزيع المؤونة ان دفع صاحب السفينة كلياً او جزئياً احدى الديون المذكورة في
الفقرة الاولى من المادة
96 ، يأخذ حين التوزيع مكان الدائن الاصلي شريطة ان يكون لهذا الدائن الحق في الدين.
