اذا تعدى محمول السفينة الخمسة براميل فيخضع عقد الاستخدام القائم بين ملاح ومجهز سفينة
او وكيله للاحكام التالية:-
1 - تقيد بنود وشروط عقد الاستخدام البحري في دفتر البحارة. ويعبر الملاح عن موافقته بتوقيع
. امضائه او بصمة اصبعه
وان السلطة المكلفة بنظام الملاحة تراقب قبل سفر السفينة قيود دفتر البحارة لتتحقق من ان
كل الملاحين النازلين في
السفينة مستخدمون بموجب عقد وتتلى شروط العقد ويستنطق المتعاقدان للتأكد من
معرفتهما مضمونه وقبولهما به. ويذكر اتمام
هذه المعاملة في هامش الدفتر.
2 - اذا لم يدون عقد الاستخدام في دفتر البحارة فيمكن اثباته بجميع الطرق.
