يجب ان يذكر في عقد الاستخدام ما يأتي:-
- كونه معقودا لمدة محدودة او لسفرة كاملة.
- خدمة الملاح او وظيفته.
- التاريخ الذي يجب ان تبتدئ فيه الخدمة او الوظيفة.
- طريقة ايفاء الاجرة المتفق عليها بين المتعاقدين.
- مبلغ الاجرة الثابتة او اساس تحديد الارباح.
- تاريخ انشاء العقد ومكانه.
- لا يكون العقد صحيحا الا اذا كان الملاح طليقا من اي استخدام آخر.
