يسقط بحكم مرور الزمن حق كل دعوى تستهدف الترك اذا لم يمارس في مهلة ستة اشهر تبتدئ
من يوم تسلم الخبر في حال الترك
بسبب هلاك كلي او بسبب الضبط او التوقيف بأمر من السلطة.
ومن يوم انقضاء المهل المحددة بالمادة 367 في حالة الترك بسبب انقطاع الاخبار.
ومن يوم انقضاء المهل المحددة في المادة 371 في حالة ترك البضائع بسبب عدم صلاح
السفينة للملاحة.
وفي سائر الحالات من اليوم الذي اتيح فيه للمؤمن له الاستفادة من حقه في الترك.
