Article 308 of Commercial Law No. 12 of 1966
Article text
1 - اذا اعتبرت المحكمة ان لمدين يستحق الاستفادة من الصلح وان الاعتراضات المبينة في المواد
السابقة لا تزيل الاغلبية
المطلوبة وان مقترحات الصلح لا تقل عن الحد الادنى القانوني وانها مشروعة وتنفيذها
مضمون ، فتقرر تصديق الصلح.
2 - وتقضي المحكمة في الحكم نفسه بوجوب ايداع حصص التوزيع التي تعود للديون المصرح
. بها
3 - اما اذا رفضت المحكمة تصديق الصلح فعليها ان تعلن الافلاس من تلقاء نفسها.
