Legal services for claiming your rights and defending your interests

Do you have an unpaid amount, an unperformed agreement or damage for which you wish to seek compensation? Has a claim been brought against you and do you need to assess the demand, documents and response?

Hjouj Law Firm & Arbitration advises and represents individuals and companies in civil disputes and financial claims. We review facts, documents and evidence to assess the legal position and suitable options, whether asserting a right or defending a claim.

Financial claims and debts

A claim may arise from a sale, service, loan, commercial dealing or unperformed obligation. We review the source and calculation of the amount and its due dates, alongside contracts, invoices, receipts, account statements and correspondence.

The assessment includes payments made, objections or later agreements, and whether documents sufficiently support the claim. We then discuss the approach and what must be completed before taking suitable action.

Contract disputes

A disagreement may concern non-performance, late delivery or payment, or differing views on the scope or quality of work. We examine the agreement, schedules, correspondence and each party's performance to understand the obligations and disputed matters.

Possible requests are assessed according to the case, including performance, sums due, or ending the relationship and its consequences. Contractual notice, settlement, jurisdiction and arbitration clauses are considered.

Compensation for damage

A compensation claim requires assessment of the act or event causing harm, the damage itself and documents supporting its existence and connection to the event. We help organise these elements and identify what requires proof or specialist expertise.

Documents may include reports, invoices, correspondence or evidence of losses and expenses. The claim's scope is discussed after review, without assuming that every loss attracts compensation or that the full amount requested will be awarded.

Defending civil claims

If you receive notice of a claim, we review the statement of claim, evidence and requests alongside your documents and account of events. This identifies matters admitted or disputed, defences and issues requiring response or proof.

The agreed service includes preparing pleadings and submissions, presenting evidence, following procedures and court representation. Mention the service date and any scheduled deadlines at initial contact to identify urgent review needs.

Evidence, documents and proving a claim

A document's existence alone does not establish the strength of a case. Its source, contents, relevance, method of presentation and potential objections must be considered. We review each item to identify its role in the claim or defence.

Some documents, such as account statements or transaction records, may need supporting evidence or testimony concerning their preparation and recorded dealings, depending on their nature and the opponent's position. We identify people with direct knowledge and documents or information needing completion.

Settlement and negotiations

A settlement may be useful before or during proceedings, particularly where a commercial relationship continues or payment needs structuring. We assess proposed offers against the claim, documents and existing obligations.

If agreement is reached, we draft settlement terms defining amounts, deadlines, payment, guarantees and consequences of breach. Releases and waivers are reviewed so they reflect the parties' intentions.

Case follow-up, judgments and appeals

You may need assistance in an existing case or a review of a judgment. We examine the file, decisions, submissions and available evidence to assess issues requiring follow-up or investigation at the relevant procedural stage.

An appeal review examines the judgment's reasons, documents, procedures and deadlines. Steps after judgment can also be discussed, including enforcement services where recovery of the awarded right needs follow-up.

What should you prepare?

Prepare a timeline explaining the start of the relationship, the parties' agreement, later events and the amount requested or claim faced. Keep contracts, invoices, receipts, account statements, correspondence and relevant court papers.

Explain earlier payments or settlements, who has direct knowledge and any notice, hearing or approaching deadline. Not all documents are needed at initial contact; missing items can be identified after understanding the matter.
