1 - اذا حكم على المفلس لافلاس تقصيري كان عقد الصلح ممكناَ.
2 - ويجوز للدائنين في حالة البدء بالاجراءات الجزائية ان يؤجلوا المذاكرة في الصلح الى ما بعد
انتهائها وفاقاَ لاحكام
