1 - على القاضي عند تحديد اثار العمل التجاري، ان يطبق العرف السائد الا اذا ظهر ان المتعاقدين
. قصدوا مخالفة احكام العرف او كان العرف متعارضا مع النصوص القانونية الالزامية
2 - ويعد العرف الخاص والعرف المحلي مرجحين على العرف العام.
