3 - الصلح بتنازل المفلس عن موجوداته
1 - يجوز عقد الصلح بالتنازل الكلي او الجزئي من المفلس عن موجوداته.
2 . - اما شروط هذا الصلح فهي نفس الشروط المنصوص عليها لعقد الصلح البسيط
3 - على ان رفع يد المفلس فيما يختص بالاموال المتنازل عنها لا ينتهي بعقد هذا الصلح بل تباع
هذه الاموال بواسطة وكلاء
يعينون كما يعين وكلاء الاتحاد.
4 - ويخضع البيع وتوزيع المال لنفس القواعد المرعية في حال الاتحاد.
5 . - ثم يسلم الى المدين من حاصل بيع الاموال المتنازل عنها مازاد عن الديون المطلوبة منه
