يتم عقد النقل حينما يتفق الفريقان على عناصره وشروطه حتى قبل تسليم الشيء الى
الناقل من قبل المرسل الا اذا اتفق
الفريقان صراحة او ضمناً على تأخير ابرام العقد الى ما بعد التسليم.
