-أ- لا يجوز ممارسة نشاط التمويل وفقا لأحكام الشريعة الاسلامية
الا من خلال شركة مسجلة لهذه الغاية فقط .
ب- تلتزم شركة التمويل الإسلامي بتعيين هيئة للرقابة الشرعية، على أن لا يقل عدد أعضائها
عن ثلاثة أشخاص من ذوي الخبرات والشروط التي يقرر البنك وجوب توافرها فيهم.
ج- تتولى الهيئة المهام التالية:-
1 - مراقبة أعمال الشركة وأنشطتها من حيث التزامها بأحكام الشريعة الإسلامية.
2 . - إبداء الرأي في صيغ العقود اللازمة لأعمالها وأنشطتها
3 . - إبداء الرأي في أي من الأمور التي تكلف بها وفقاً لأوامر تصدر عن البنك
