: على وصي التركة ان يصرف من مال التركة
1 - نفقات تجهيز الميت ونفقات مأتمه.
2 - استصدار امر من المحكمة بصرف نفقة كافية الى الوارث المحتاج على ان لا تتجاوز مقدار ما
يصيبه من التركة وبحالة
ما اذا كان الدين جزءا منها حتى تنتهي التصفية على ان تحسم النفقة من نصيبه في التركة
وتفصل المحكمة في كل نزاع يتعلق
بهذا الخصوص.
