1 - يرفض سماع الاشهاد اذا اشتمل على تصرف ممنوع او باطل او اذا ظهر ان الواقف فاقد الاهلية.
2 . - على انه اذا اقترن الوقف بشرط غير صحيح صح الوقف وبطل الشرط
