1 - لا يجوز تحكير الاراضي الموقوفة باقل من اجرة المثل.
2 . - وتزيد الاجرة اذا زاد اجر المثل في نفسه زيادة فاحشة لا تقل عن الخمس
3 . - ولا تلزم المحتكر الزيادة بسبب البناء او الغراس
